If a New York State court grants Fox Corporation and Fox News Network, LLC summary judgment dismissing all of Smartmatic's remaining claims against them in Smartmatic USA Corp. v. Fox Corp., Index No. 151136/2021, or any appeal thereof before Jan 1, 2028, then the market resolves to Yes.

Every claim Smartmatic still asserts against both Fox Corporation and Fox News Network, LLC must be dismissed. Claims that remain against any other defendant, and Fox's own counterclaims, do not prevent a YES. The ruling must: Be issued by a New York State court in Smartmatic USA Corp. v. Fox Corp., Index No. 151136/2021, or any appeal of it Address the matter described by the specified judgment Be issued through a written order, opinion, judgment, or decision The following do NOT satisfy the Payout Criterion: The March 8, 2022 decision, or any later decision, holding that Smartmatic's claims have a substantial basis in law or that actual malice is adequately alleged Denial of Fox's motion for summary judgment An order that dismisses only some claims, some broadcasts or some defendants while the rest proceed A jury verdict or a judgment entered on one Oral rulings from the bench unless reduced to a written order Tentative rulings that are not made final Settlements or voluntary dismissals Administrative or scheduling orders
